Bryan Hicks

Bryan has been described by clients and colleagues as a “business disputes specialist” (and on occasion by his friends and family as a “disputes enthusiast”).  He takes a very practical approach to the practice of law, focusing on obtaining positive outcomes so clients can focus their energies on running their businesses, organizations, and personal lives.

Maintaining a broad corporate and commercial litigation practice, Bryan has particular expertise in shareholder, director, complex contractual, and real property disputes.  He also has experience representing clients in plan of arrangement proceedings, and a variety of restructuring and insolvency matters.

Bryan appears regularly in the Supreme Court of British Columbia, and has also appeared before the British Columbia Court of Appeal, Federal Court, and has assisted clients with regulatory investigations.  He has also achieved positive outcomes through alternative dispute resolution, and informal “boardroom litigation”.

Best Lawyers has recognized Bryan in the areas of corporate and commercial litigation, as has Benchmark Litigation.  Prior to joining Allen / McMillan, he practiced at two top ranked national business law firms.

Bryan resides in North Vancouver with his wife and son but has been told he lives in the 1990s when it comes to music, television, film, and fashion, which he takes as a compliment.

Significant Cases

  1. 1355866 B.C. Ltd. v Chahal, 2024 BCSC 758:  represented a group of sellers in litigation concerning a complex property transaction.  Bryan successfully defended an application to have his clients’ certificate of pending litigation and mortgage canceled.

  2. Royal Bank of Canada v MBA Asset Management Inc., 2024 BCSC 546:  represented an interested party in receivership proceedings in which court approval was obtained for a sale transaction by way of reverse vesting order.

  3. Bron Media Corp. (Re), 2023 BCSC 1563: represented a film production company in contested proceedings under the Companies’ Creditors Arrangement Act.

  4. Whiffen v Whistler Rainbow Properties Ltd., 2022 BCSC 1241:  represented a property developer in litigation concerning the design and sale of a luxury home in a Whistler-area development.

  5. Ibrahim v Mahboub, 2018 BCSC 1654:  represented owners of a valuable luxury home in successfully having a certificate of pending litigation canceled without the requirement to post replacement security.

  6. Marine Harvest Canada Inc. v Morton, 2017 BCSC 2383:  obtained an injunction to prevent protesters from interfering with his client’s aquaculture facilities. See also Marine Harvest Inv. v. Morton, 2018 BCSC 1302 where the scope of the injunction was expanded.

  7. Falcone v Maddern, 2017 BCSC 790:  represented the defendant in obtaining an injunction to prevent the plaintiffs from interfering with the defendant’s right to access.

  8. Lockwood Financial Ltd. v China Blue Chemical Ltd., 2015 BCSC 839:  represented a foreign corporate defendant in having proceedings dismissed that were commenced in the Supreme Court of British Columbia.

  9. Save Halkett Bay Marine Park Society v Canada (Minister of the Environment), 2015 FC 302:  represented a project proponent in judicial review proceedings upholding a Disposal at Sea Permit for a large marine project.

  10. Roots v HMCS Annapolis (Ship), 2015 FC 1339:  represented a project proponent in having a claim by a contractor dismissed and a vessel released from maritime arrest without bail.

  11. Patrick v MGX Minerals Inc., unreported: represented a company in a dispute among directors regarding the casting vote on a board resolution to terminate the President, CEO, and signing authority.
